Back-up  singer Carmen Smith has been kicked off The Voice after starring in Guy Sebastian's new film clip.

The black and white music video features Smith playing tambourine, singing and dancing alongside the Idol winner, which according to Channel 9 is 'an unfair advantage as the show moves into the public voting stage as the video is on current release and highly visible.'

Smith will not perform in Monday's live show, meaning coach Joel Madden will only have five singers performing against Keith Urban's six.

'This was not a decision we and Team Joel took lightly. Our priority as we move into the voting period  toward the finale is that all of the artists are on a level playing field' said Nines director of development Adrian Swift.'In our business we are often confronted by these tough decisions and unfortunately at this time it's been decided that it isn't appropriate for her to remain in our competition. We wish Carmen well and thank her for a wonderful contribution to the show thus far.'

The statement released by Nine also includes a statement by Smith: 'It saddens me that I am leaving The Voice earlier much earlier than I had hoped' she said.'However, I've loved every minute of it and respect the decision that has been made by Joel and his team. I've sung on Guy's albums and been part of his band for many years so Im thrilled to be in the clip and am looking forward to getting back to work and also working on my solo career.'

It is unclear what this will mean for Madden and his team but Smiths departure could result in only one of Madden's singers being eliminated after their live performances on Monday.

A second male massage therapist is claiming John Travolta rubbed him in a very wrong way.

The anonymous masseur has joined a federal suit filed in California with accusations the 'Pulp Fiction' star groped him and tried to force a happy ending during a private massage in an Atlanta hotel room January 28.

The new plaintiff is represented by the same southern California lawyer who filed a sexual battery lawsuit May 4 claiming Travolta tried to initiate sexual relations with another masseur in a Beverly Hills hotel January 16.

Travolta, 58, blasted the initial suit as a 'baseless lie' Monday. This lawsuit is a complete fiction and fabrication' Travoltas representative told the Daily News. 'On the date when plaintiff claims John met him, John was not in California, and it can be proved that he was on the East Coast' he said.

The first plaintiff claims Travolta picked him up in a black Lexus SUV, drove him to the Beverly Hills Hotel and then groped him, masturbated openly in his presence and made lewd comments during the course of the $200-per-hour session.

The Avengers has set a new bar in opening to a walloping $200.3 million at the domestic box office, the largest debut ever!

Avengers opened a week ago overseas, earning a whopping $441.5 million through Sunday. The pic's worldwide total of $641.8 million has already surpassed the lifetime totals of Captain America: The First Avenger ($364 million), Thor ($449 million), Iron Man ($585 million) and Iron Man 2 ($624 million).

Avengers is now positioned to reach $1 billion in global grosses.Among other records, Avengers is the first film in history to cross $200 million in only three days of play at the domestic box office. It also scored the biggest Saturday gross of all time in earning $69.7 million.
